MEDIATION FEE SCHEDULE
Customary Compensation Rates
Two Party Cases: $500/hour
Multiple Party Cases: $500/hour + $50.00/hour for each additional party
Travel Time Outside the Bay Area: $250/hour.
Administration Fee: one-time fee of $150 billed when a mediation is scheduled
The total fee, billed in one-tenth hours, is based upon the number of hours for all time expended in connection with the mediation, including, but not limited to, intake, telephone calls, correspondence, study time, pre-mediation conferences, mediation and follow-up conferences and correspondence. Unless the parties agree otherwise, the fee is to be allocated equally.
Special Compensation Rates
Early Reservation: $400/hour for the first four cases scheduled each month
Unmarried Partner Dissolutions: $450/hour
Reduced Fees: available for good cause.
Daily Rates: available upon request.
Deposit and Late Payment Policy
A deposit of estimated fees, to be determined by the mediator, is due within seven days of receipt of a Statement of Deposit in order to reserve a mediation date. Excess fees will be returned at the termination of the mediation. Fees not paid by the deposit are due immediately upon receipt of the mediator’s Statement of Account. Payments made past the due date are subject to interest at the rate of ten percent per annum.
Minimum Time to Be Reserved
The minimum amount of time that may be reserved for a first mediation session is four hours. There is no minimum reservation restriction for follow-up mediation sessions.
Cancellation and Rescheduling Policy
More than 14 Days Notice: If a mediation date is canceled or rescheduled more than 14 days before the mediation, the party responsible for the change must pay a cancellation fee of $200.
Less than 14 Days Notice: If a mediation date is canceled or rescheduled within fourteen days of the mediation, the party responsible for the change must pay a cancellation fee equal to the total amount of the deposit for all parties.
Responsible Party: If the parties disagree about who is responsible for the change, the parties must each pay their pro rata share of the required deposit, without waiving any right to reimbursement by the other parties at a later time.
Cancellation and rescheduling fees are in addition to any fees incurred for pre-mediation work, which will be billed in accordance with the parties’ agreement regarding allocation of fees.
